fixed or unspecified slices for confied aquifer

Hi,

The top slice of a confined aquifer has to be set as fixed?? Or it can be set as unspecified??

what happen with the layers, which are below the confined layer defined by a top fixed slice?
Are they also confined, even if they are defined as unspecified?
